A CEFN Fforest man was imprisoned for threatening to rip a police officer’s head off, then spitting in her face.

Andrew Davies, 41, of Waunborfa Road, appeared at Cardiff Crown Court where he was sentenced to 26 weeks for two charges of resisting arrest and one charge of assaulting PC Ceri Chard.

The sentence included 18 weeks for grievous bodily harm, a previous sentence which was suspended for two years in February 2010, but was breached by these incidents.

Davies pleaded guilty to two counts of resisting arrest, but was found guilty of assault on PC Chard following a trial at CaerphillyMagistrates Court last month.

Prosecutor John Probert told the court that police officers were called to Shirley’s Hairdressers, Cefn Fforest, on February 2, 2010, where Davies was drunk with his brother.

The caller told police to “expect problems”, with Davies initially agreeing to leave, but then becoming aggressive.

Mr Probert said he charged at PC Chard and PC Dean Dugmore swinging his arms and shouting: “I’m going to rip your head off, come on fight me.”

Spray was used on Davies, before he was led outside and after again resisting, he was put in handcuffs.

Mr Probert said he then spat on PC Chard, leaving the officer “disgusted” with her face “covered in saliva”.

Defence barrister Joanna Jones said Davies’ nephew had called police because the defendant was drunk.

She said a disproportionate amount of force was used getting him from the building, adding that he denies spitting in the officer’s face.

Judge Neil Bidder QC said: “Police officers doing their job deserve not to have people spit in their face when arresting them.”

He sentenced Davies to eight weeks for the assault and two weeks for each of the resisting arrest charges, to run concurrently.

Eighteen weeks of the suspended sentence was added to this, making 26 weeks, of which Davies must serve half.
